Summary:
The now 29 year old accused pleaded guilty to robbery in 2013. He was sentenced to nine weeks' imprisonment after 1.0 to 1.0 credit for 14 months' pre-trial custody. The Crown appealed against sentence, seeking a sentence of 38 months' imprisonment, less credit for pre-trial custody, for a net sentence to be served of two years less a day. The Crown argued that the trial judge erred in crafting a sentence outside of the usual range because the accused was an aboriginal offender suffering from fetal alcohol syndrome ("extremely low" range of intellectual functioning). His mental age was 10-12 and he had cognitive deficits. The accused had multiple prior convictions for theft, robbery, breaching probation orders, escaping lawful custody, etc.
The Yukon Court of Appeal dismissed the appeal. A judge did not err simply by imposing a sentence that was admittedly below the low end of the usual range of sentences. The sentencing judge, faced with exceptional circumstance, did not err in imposing the sentence that he did given the accused's moral culpability and the need for rehabilitation as the best option of protecting society.
