Retailers - Regulation - Weights and measures - Alteration of motor vehicle odometer - Weights and Measures Act, s. 37(1) - A car dealer was charged with altering an odometer to show 16,000 miles rather than the true mileage of over 40,000 miles - The sales manager of the dealer testified that he had no knowledge of any employee changing an odometer - The New Brunswick Provincial Court convicted the dealer - The Provincial Court stated that s. 37(1) of the Weights and Measures Act required that the dealer show by affirmative proof that due diligence was exercised, which the dealer failed to do.
