The accused were charged with an indictable offence under the Customs Act. At the commencement of their trial before the New Brunswick Provincial Court they objected that the court had no jurisdiction over offences under the Customs Act and had no jurisdiction over indictable offences in general.

The New Brunswick Provincial Court overruled the objections.
