Summary:

The accused was charged with theft, contrary to s. 334(a) of the Criminal Code. The Crown alleged that, while employed as an administrative assistant by the Western Regional Health Authority at a community Health Center, the accused stole $7,394.78 from her employer.

The Newfoundland and Labrador Provincial Court, in a decision reported at [2014] Nfld. & P.E.I.R. Uned. 46, convicted the accused.

The Newfoundland and Labrador Provincial Court sentenced the accused to 90 days' incarceration, to be served on an intermittent basis, plus 12 months' probation. In addition to the statutory terms of probation, the accused had to: report to a probation officer in person as required; comply with all directions received from her probation officer; attend all counseling or treatment sessions arranged by her probation officer; and make a $500 contribution to a food bank chosen by her probation officer.

Sentence - Theft - While employed as an administrative assistant by a Regional Health Authority at a community Health Center, the accused stole $7,394.78 from her employer, from funds the accused was responsible for maintaining - The accused repaid the money - 41 years old - No prior convictions - At the time of the theft, the accused's son was facing some debt problems that might have been connected to the drug trade and the accused paid for his legal fees - Now employed elsewhere, the accused illustrated a significant work ethic - The Newfoundland and Labrador Provincial Court sentenced the accused to 90 days' incarceration, to be served on an intermittent basis - A noncustodial sentence would not reflect the serious nature of the offence and the significant violation of public trust - An intermittent sentence would satisfy the principles of sentencing while allowing the accused to maintain her employment - The court also imposed 12 months' probation - In addition to the statutory terms of probation, the accused had to: report to a probation officer in person as required; comply with all directions received from her probation officer; attend all counseling or treatment sessions arranged by her probation officer; and make a $500 contribution to a food bank chosen by her probation officer.
