Summary:
This case arose out of a charge of murder against the accused. The accused was charged as a party to the offence on the ground that he aided and abetted it. The accused was convicted before a judge and jury. The accused appealed on the ground that the trial judge committed errors in his charge to the jury.
The Alberta Court of Appeal allowed the appeal, set aside the conviction of the accused and ordered a new trial. The Court of Appeal held that the trial judge erred in instructing the jury that the defence of compulsion was not available to the accused, as a person accused of aiding and abetting the offence of murder - see paragraphs 6 to 12.
The Court of Appeal held that the trial judge failed to make clear to the jury that in a charge of aiding and abetting an offence, the Crown must prove that the acts which the accused did were for the purpose of encouraging the offence - see paragraphs 13 to 24.
