Summary:
The accused Currie was charged with four counts of theft and two of fraud. His co-accused, Bruce, was charged with two counts of fraud. Currie was convicted on all six counts and sentenced to three years' imprisonment. Bruce was also convicted on two counts and sentenced to 18 months' imprisonment. Both accused appealed against conviction and sentence.
The Ontario Court of Appeal applied the rule in R. v. Kienapple and quashed the conviction of each accused on the second count of fraud. The court of appeal otherwise dismissed the appeals against conviction and sentence.
