Alberta Court of Appeal

McGillivray, C.J.A., Laycraft and Kerans, JJ.A.

January 27, 1982.

Summary:

The Crown sought leave to appeal a sentence of a fine of $500.00 and probation for one year imposed upon the respondent for attempted theft of an automobile on the ground that the Provincial Court judge wrongly interrupted s. 28 of the Provincial Court Act, S.A. 1971, c. 86, when it refused to hear the respondents juvenile record without the written consent of the Attorney General.

The Alberta Court of Appeal granted leave to appeal. The court held that the juvenile record may be disclosed to a criminal court without the consent of the Attorney General.
