Summary:
The RCMP obtained a search warrant under the Mutual Assistance in Criminal Matters Act to search the respondents' premises. A search was conducted and numerous records and things were seized. A notice of hearing to consider the execution of the search warrant was served to the respondents. The Crown applied for an order sending the items seized to the United States, which had requested assistance under the Act.
The Alberta Court of Queen's Bench, in a decision reported 248 A.R. 82, allowed the application. The respondents applied for leave to appeal.
The Alberta Court of Appeal, per Picard, J.A., dismissed the application.
