Motor vehicles - Impaired driving - Breathalyzer - Demand for breath sample - The Alberta Court of Queen's Bench held that under s. 235 of the Criminal Code only one demand for breath samples was necessary and once given the demand continued to have effect until the samples were given - See paragraphs 8 to 12.

Criminal Law - Topic 1378

Motor vehicles - Impaired driving - Breathalyzer - Refusal to provide breath samples - Reasonable excuse - The accused was convicted of refusing to provide breath samples contrary to s. 235(2) of the Criminal Code - The accused appealed on the ground that the test was not given "as soon as practicable" - The accused was given the demand at the scene - The accused was taken to the police station and had to wait 40 minutes before a machine was available for him to take the test - The Alberta Court of Queen's Bench dismissed the appeal and held that the test was given as soon as practicable - The Queen's Bench held that, even if there was an unexplained and unreasonable delay, it could only be used as evidence to the contrary in s. 237 of the Code and not as a reasonable excuse for refusing to provide breath samples - See paragraph 18.
