Summary:

This case arose out of an application by the Crown under s. 689 of the Criminal Code of Canada, R.S.C. 1970, c. C-34, for the preventive detention of the appellant. The appellant had a criminal record of nine convictions for indecent assault on nine boys ranging in age from 11 to 17 over a period of nine years. None of the boys were physically hurt. The Crown applied to the Alberta District Court for the preventive detention of the accused as a dangerous sexual offender within the meaning of s. 687 of the Criminal Code. Psychiatric testimony was to the effect that there was not likely to be lasting psychological damage to a boy involved in such an incident. The appellant, who was a paedophiliac and a homosexual, was likely to continue his behaviour, if released. The District Court found that the appellant was a dangerous sexual offender and sentenced him to preventive detention. The appellant appealed.

The Alberta Court of Appeal dismissed the appeal and affirmed the findings of the District Court.

C-34 - The Alberta Court of Appeal stated that the determination of whether a person was a "dangerous sexual offender" for the purpose of preventive detention was a matter of sentencing, not of an offence, and that it was not necessary to find beyond a reasonable doubt that other sexual offences would be committed by the accused in future - See paragraph 20.
