Summary:

The accused appealed his conviction for driving with an excessive blood-alcohol content contrary to s. 236 of the Criminal Code of Canada.

The Manitoba County Court dismissed the appeal.

Motor vehicle - Impaired driving - Breathalyzer - Certificate evidence - Evidence to the contrary - What constitutes - The accused's breathalyzer readings indicated a blood-alcohol content of .19 - An expert testified that giving the accused's consumption and his physical condition, the reading would not exceed .02 and that therefore the machine had either failed or the test had not been properly conducted - The Manitoba County Court held that, although the expert's evidence must be given due weight and consideration, it did not constitute evidence to the contrary - See paragraphs 11 to 24.
