Sentencing - Considerations - Time already served - The accused was convicted of one count of criminal harassment - The Crown argued that the accused should be denied the usual two for one credit for pre-trial custody because of his misconduct - The sentencing judge rejected this argument where the accused had been segregated for most of the time he spent in the local jail (i.e., "hard time"), his sentencing was delayed because of an assessment application and he had taken a dramatic step toward rehabilitation while in custody (i.e., surgery to improve an organic condition) - A Case Commentator discussed the following issues arising from the decision in this case: (1) whether there was a usual credit to be calculated on a "two-for-one" basis; (2) whether the court could deny or reduce credit for misconduct; and (3) whether pre-trial credit could be enhanced in light of unusual hardships faced by a detainee - See paragraphs 1 to 80.
