Summary:

The accused was convicted of indecent assault, incest, touching for a sexual purpose and two counts of sexual assault. The vic­tims were his two daughters.

The Nova Scotia Supreme Court sentenced the accused to four years' imprisonment on each sexual assault count (consecutive), two years' imprisonment for indecent assault (concurrent), five years' imprisonment for incest (concurrent) and 18 months' imprison­ment for touching for a sexual purpose (consecutive), for a total of 9.5 years' im­prisonment.

Sentence - Sexual assault - The 41 year old accused father sexually abused his now 21 year old daughter for nine years, start­ing when she was five years old - The incidents started with sexual touching and progressed to oral sex and intercourse - When that daughter left home, the accused started sexually abusing a younger daugh­ter - Those incidents had not progressed beyond sexual touching when the daughter told authorities - Evidence of physical abuse of both children - Neither lived in the home now - Both were estranged from other family members and suffered signifi­cant victim impact - Accused con­tinued to deny the abuse and expressed no remorse - Continual nature of offences a signifi­cant aggravating factor - The accused was convicted of indecent assault, incest, touching for a sexual pur­pose and two counts of sexual assault - The Nova Scotia Supreme Court sentenced the accused to a total of 9.5 years' im­prison­ment.
