Summary:

The accused was charged with fishing for gaspereau during a weekly close time con­trary to s. 79(a) of the Fisheries Act of Canada.

The Nova Scotia Provincial Court ordered a stay of proceedings because the Crown failed to comply with s. 11(2) of the Statu­tory Instruments Act (Can.) and the defence proved officially induced error.

Operation and effect - Delegated legisla­tion - Regulations - Requirement of public notice - Section 11(2) of the Statutory Instruments Act (Can.) prohibited a con­viction for an offence under a regulation not published in the Canada Gazette unless reasonable steps were taken to bring the purport of the regulation to the notice of persons likely affected by it - A 1999 variation order respecting the gaspereau fishery decreed a weekly close time and was published only in newspapers - A license issued to Gillis in 2000 stipulated that "Subject to any variation orders that may be issued" the license conditions were valid from March 21, 2000 to December 31, 2000 - In 2000, Gillis was charged with fishing gaspereau during the weekly close time - The Nova Scotia Provincial Court ordered a stay of proceedings where the license had not drawn Gillis' attention to variation orders issued before March 21, 2000 and the combined effect of the license condition and the newspaper cre­ated "confusion and contradiction" - Hence, s. 11(2) was not complied with - Also, officially induced error was proved.
