Summary:
The accused pleaded guilty to attempted murder and was sentenced to two years less a day plus three years probation. A 20 year prohibition order under s. 98 of the Criminal Code of Canada was also made. The Crown appealed against sentence.
The Ontario Court of Appeal allowed the appeal and increased the sentence to seven years. The Court affirmed the prohibition order.

Sentence - Attempted murder - 31 year old accused pleaded guilty to the attempted murder of his 30 year old estranged wife - He shot her in the head three times with a .22 calibre rifle - She lived, but suffered severe brain damage - The couple had two small children - The accused was severely depressed and needed medical treatment - First offence - The Ontario Court of Appeal increased his sentence from two years less a day plus three years probation to seven years imprisonment, to reflect the gravity of the offence.
