Summary:

The accused were charged with narcotic-related offences. They alleged violation of their s. 11(b) Charter right to be tried within a reasonable time. The Crown proposed to cross-examine the accused on their affidavits filed in support of the Charter application. The accused argued that the Crown intended to use the cross-examination to bolster voice identification evidence respecting wiretap conversations, in violation of their s. 13 Charter right.

The Ontario Court (General Division) observed that the accused waived their right to remain silent only to the extent that they were required to establish that prejudice was occasioned by the delay and that s. 13 of the Charter gave witnesses the right not to have incriminating evidence used in any other proceeding. The court found that s. 24(1) extended to preventing a threatened or imminent breach of a Charter right. The court ruled that tape-recording of the cross-examination of the accused was prohibited.
