December 21, 1982.

Summary:

The accused was charged with driving while impaired by alcohol contrary to s. 234 of the Criminal Code of Canada. The trial judge convicted the accused and relied on opinion evidence of two police officers. The accused appealed on the ground that the opinion evidence was inadmissible.

The Ontario County Court dismissed the appeal. The accused appealed to the Ontario Court of Appeal.

The Ontario Court of Appeal dismissed the appeal. The judgment of the Court of Appeal is set out below - see paragraphs 63 to 103. The accused appealed to the Supreme Court of Canada.

The Supreme Court of Canada dismissed the appeal.
