Summary:

The Ontario Provincial Court ruled that a Uzi machinegun was a "prohibited weapon" under s. 84(1) of the Criminal Code and ordered that it be forfeited to the Crown. The decision was confirmed on appeal. The owner of the gun appealed.

The Ontario Court of Appeal, Tarnopolsky, J.A., dissenting, in a judgment reported 50 O.A.C. 186, allowed the appeal. The gun had been destroyed, so the court, lacking specific authority to order payment of com­pensation, urged the Crown to compensate the owner. The Crown appealed.

The Supreme Court of Canada, Major, J., and Lamer, C.J.C., dissenting, allowed the appeal and restored the order of the Provin­cial Court judge.

Criminal Law - Topic 1144

Prohibited weapons - What constitute - Section 84(1)(c) of the Criminal Code defined "prohibited weapon" as a firearm "capable of firing bullets in rapid suc­cession with one pressure of the trigger" - A semi-automatic Uzi machinegun was, by manufacture, incapable of firing bullets in rapid succession, but could be easily adapted to do so - The Supreme Court of Canada stated that whether "capable" meant "immediately capable" or "readily capable" depended upon the purpose and goals of the prohibited weapons provisions - The court stated that restricting the meaning of capable to immediately capable would defeat the intention of the legisla­tion, because simple removal of a part from an automatic weapon could take it out of the definition - The court stated that a firearm that had the potential to be readily converted to a fully automatic weapon in a relatively short period of time with relative ease was a prohibited weapon.
