Harrigan, C.J.P.C.
January 29, 1985.
Summary:
The accused was charged with possession of marijuana.
The New Brunswick Provincial Court acquitted the accused.
Narcotic Control - Topic 577
Offences - Possession - Constructive possession - Marijuana was found by police officers in a suitcase owned by the Premier of New Brunswick in a security check of luggage to be carried on the plane carrying the Queen and the Premier from Fredericton to Moncton - The Premier denied knowledge of the marijuana in his suitcase - The New Brunswick Provincial Court, strongly suspecting that the marijuana was planted in the Premier's suitcase, acquitted the Premier of possession of marijuana on the ground that the Crown failed to prove possession of the marijuana by the Premier.
Counsel:
C. David Hughes, Q.C., and James D. Bissell, for the Crown;
Donald M. Gillis, Q.C., Rodney J. Gillis, and Gary A. Miller, for the accused.
This case was heard at Fredericton, N.B., before Harrigan, C.J.P.C., of the New Brunswick Provincial Court, who delivered the following oral judgment on January 29, 1985.
