Summary:

The 32 year old accused pleaded guilty to: (1) possession for the purpose of trafficking not in excess of 3kg of cannabis marijuana (Controlled Drugs and Substances Act (CDSA), s. 5(2)); (2) trafficking in cocaine (CDSA, s. 5); (3) possession of brass knuckles (Criminal Code, s. 92(2)); and (4) possession of a throwing star (Criminal Code, s. 92(2)). While the accused was at large on bail pending sentencing (he had requested a pre-sentence report), he was stopped while driving almost two hours after his curfew. He was arrested for (5) breach of undertaking, and had remained in custody since.

The Newfoundland and Labrador Provincial Court sentenced the accused as follows: (1) for possession for the purpose of trafficking not in excess of 3 kg of cannabis marijuana, three months, concurrent to the cocaine related offence; (2) trafficking in cocaine, 619 days (720 days less 101 days' credit for time spent on remand); (3) possession of brass knuckles, 30 days, consecutive; (4) possession of a throwing star, 30 days, concurrent; and (5) breach of undertaking, 30 days, consecutive. The court made a number of ancillary orders.

Sentence - Trafficking in a narcotic or a controlled drug or substance (incl. possession for the purpose of trafficking) - The accused, a 32 year old first offender, pleaded guilty to (1) possession for the purpose of trafficking of 28 small baggies of marijuana and (2) trafficking in cocaine - He was a mid-level cocaine dealer and a low-level marijuana dealer - When searched, he had in his possession a number of sets of brass knuckles, an extendable baton, a throwing star, and two starter pistols - He pleaded guilty to (3) possession of the brass knuckles and (4) the throwing star - The other charges were withdrawn - While on judicial interim release, the accused was found 50 km from home, almost two hours after his curfew - He was arrested for (5) breach of undertaking and had remained in custody since - The Newfoundland and Labrador Provincial Court sentenced the accused as follows: (1) for possession for the purpose of trafficking not in excess of 3 kg of cannabis marijuana, three months, concurrent to the cocaine related offence; (2) trafficking in cocaine, 619 days (720 days less 101 days' credit for remand time); (3) possession of brass knuckles, 30 days, consecutive; (4) possession of a throwing star, 30 days, concurrent; and (5) breach of undertaking, 30 days, consecutive - The court stated that had it not been for the guilty plea, the positive presentence report, and the s. 726 allocution, it would have imposed 30 months for trafficking in cocaine.
