Summary:

The accused was charged with breathalyzer refusal contrary to s. 238(5) of the Criminal Code.

The New Brunswick Provincial Court held that the accused's right to counsel was denied and that certain evidence be excluded from the record. In the result, the court dismissed the information and acquitted the accused.
