Indian and Eskimo rights - Right to fish - Non-treaty Indians - The accused non-treaty Mic Mac Indian was caught fishing with a net on the Restigouche River within the Province of New Brunswick - Fishing with a net at that point was prohibited by Regulations under the Fisheries Act, R.S.C., 1970, c. F-14 - The accused claimed an aboriginal right to fish, notwithstanding the prohibition - The New Brunswick Provincial Court convicted the accused and held that non-treaty Indians were not exempt from the provisions of the Fisheries Act.
