Criminal Law - Topic 1422
Assaults - Defences - Consent - The Ontario Court of Appeal held that the concept of consent as used in s. 244 of the Criminal Code (definition of assault) should be interpreted subject to the same limitations as are imposed by the common law - The court held that consent is not a defence to assault if actual bodily harm is intended or caused - The Crown is not obliged to prove absence of consent as a necessary element to a charge of assault.
