Food and Drug Control - Topic 1084
Drugs - Possession for purpose of trafficking - What constitutes - Food and Drugs Act, R.S.C. 1970, c. F-23, s. 40 - The accused and three of his friends entered into a joint venture for the purpose of buying 405 "hits" of LSD - Ostensibly the LSD was for their own use; although one of the accused's three friends was to take the largest share - The accused was found in possession of the LSD before he could give it to his friends - The accused was charged with possession for the purpose of trafficking - The Alberta Court of Queen's Bench held that the accused was not guilty - The Court of Queen's Bench held that, unlike the law under the Narcotic Control Act, a joint venture for the acquisition of a drug did not constitute trafficking under the Food and Drugs Act.
