Summary:
The accused pleaded guilty to a charge of importing marijuana into Canada. Canada Customs had found 13 pounds of marijuana in the rear wheel of the accused's vehicle. The accused had no prior record and was employed.
The Ontario Court (General Division) imposed a 12 month conditional sentence plus one year of probation. The court stated that it did not accept the view that a conditional sentence was not an appropriate disposition for marijuana based offences.
