Summary:

The accused, a police officer, was charged with making an indecent telephone call (Criminal Code, s. 372(2)), and making a false statement to the police (public mischief) (s. 140(1)(b)). The essence of the allegations was that the accused made an indecent telephone call to a young woman at her place of employment and subsequently misled the police by making a false statement implicating another person.

The Newfoundland and Labrador Provincial Court, in a decision reported at [2015] Nfld. & P.E.I.R. Uned. 13, found the accused guilty.

The Newfoundland and Labrador Provincial Court sentenced the accused to four months' imprisonment for making an indecent telephone call, and six months consecutive for making a false statement to the police, followed by 12 months' probation.

Sentence - Public mischief - Kelly, an on-duty police officer, used his police-issued cell phone to call a young woman (AH) at her place of employment - Kelly made reference to sexual acts, indicated that he knew what AH was wearing, and that she was alone - During a subsequent investigation which linked Kelly's phone to the call, Kelly lied to three police officers and provided a detailed written statement in which he falsely blamed X for committing the offence - Kelly had been grooming X as a possible police informant - X became a suspect and was investigated - Kelly was found guilty of making an indecent telephone call and making a false statement to the police (public mischief) - The Newfoundland and Labrador Provincial Court sentenced Kelly to four months' imprisonment for making an indecent telephone call and six months consecutive for making a false statement, followed by 12 months' probation - Both offences constituted a massive breach of the public trust placed in Kelly as a police officer - His false statement contravened his general duty to uphold the law in the worst possible manner - A conditional sentence would not reflect Kelly's moral blameworthiness, his responsibility for the offences, or the breach of public trust - If the Crown had proceeded by indictment rather than by way of summary conviction, the court would have imposed a sentence of 20 months' imprisonment.
