Jurisdiction - Loss or suspension of jurisdiction - Failure of court to proceed with trial - The trial of the accused was set down for a certain time and court room - Because of a mix-up, the case was called at a different time and court room - The accused appeared at the appointed time and court room, but the court did not proceed, because the case was not on the list of scheduled cases to be heard - The accused applied for and obtained an order prohibiting the court from further dealing with the information - The Crown appealed - The Alberta Court of Appeal dismissed the appeal - See 9 A.R. 288 - The Court of Appeal held that the court lost jurisdiction over the information when it failed to proceed at the appointed time - The Court of Appeal held that s. 440.1(1) of the Criminal Code of Canada, R.S.C. 1970, c. C-34, was inapplicable to cure the error - The Supreme Court of Canada dismissed the Crown's appeal and affirmed the decision of the Court of Appeal.
