Right to counsel - Instructing counsel - Right to privacy - An accused, charged with impaired driving, was not advised of his right to communicate in private with counsel - He had phone access for one hour and 41 minutes - When he contacted his lawyer he had five minutes in private plus an additional 22 minutes during which time an officer observed him from a dis­tance of six to twelve feet - The officer heard mumbles - Renovations prevented the accused from being observed without being overheard - The officer did not pressure or hurry the accused, but encour­aged him to pursue his right to counsel - The Nova Scotia Provincial Court held that the accused's s. 10(b) inherent Charter right to communicate with counsel in private was not violated.
