Summary:

The accused pled guilty to one count of possession of ketamine for the purpose of trafficking, contrary to s. 5(2) of the Controlled Drugs and Substances Act.

The Saskatchewan Court of Queen's Bench sentenced the accused to 15 months' imprisonment, less nine days for time already served.

Sentence - Trafficking in a narcotic or a controlled drug or substance (incl. possession for the purpose of trafficking) - A package containing about one-half kilogram of ketamine was intercepted at an airport - The package was addressed to Kryschuk - Police effected a controlled delivery of the package through a post office - Kryschuk's roommate, Kubashek (the accused), attempted to pick up the package but was advised that it would only be released to Kryschuk - Kryschuk picked up the package and brought it back to his residence - Police searched the residence and found the package sitting unopened on the kitchen counter - Kubashek pled guilty to possession of ketamine for the purpose of trafficking - He alleged that someone had threatened to harm his 11 year old son if he did not participate in picking up packages, and that he did not know what the packages contained - He had a criminal record, but no prior drug-related convictions - Kubashek had been stigmatized and embarrassed in the small community where he lived and worked due to media reports that associated him with a "date rape" drug - He had disassociated himself from his former friends, including Kryschuk, since being arrested - The Saskatchewan Court of Queen's Bench held that a conditional sentence would not be consistent with the fundamental purposes and principles of sentencing - Kubashek was sentenced to 15 months' imprisonment, less nine days for time already served.
