Special powers - Search warrants - Issue of - Duty of judge respecting - At the accused's house, police executed a search warrant issued under s. 11 of the Controlled Drugs and Substances Act - Marihuana was found and the accused was charged - The British Columbia Court of Appeal held that the test to determine whether the search warrant was properly issued and not in breach of s. 8 of the Charter was whether the justice of the peace acting judicially on the information before her could have had reasonable and probable grounds to believe that an offence was being committed at the subject address - The question was whether the evidence was sufficient to found a "credibly-based probability" - See paragraphs 1 to 11.
