Summary:

The accused pleaded guilty to aggravated assault.

The Newfoundland and Labrador Provincial Court sentenced the accused to 18 months' imprisonment, less 117 days for 78 days pretrial custody, and two years' probation. The court also imposed a 10 year firearms prohibition and a DNA order.

Sentencing - Considerations on imposing sentence - Denunciation or repudiation of conduct - The accused pleaded guilty to aggravated assault - The accused was in an area where there were a number of clubs, bars and restaurants in close proximity - He punched the victim once in an unprovoked attack and fled - The victim fell and struck his head on the curb - He was rendered unconscious - He suffered a life threatening injury to his head - He was hospitalized and continued to suffer life altering consequences - The accused apologized but attempted to minimize his culpability and shift at least some of the blame to the victim - He was gainfully employed and supported by the community - Good prospects for rehabilitation - The Newfoundland and Labrador Provincial Court stated that unprovoked public attacks caused the greater community to fear going about their daily activities and when they attended such areas as where the attack occurred - A significant statement of denunciation was required - The court sentenced the accused to 18 months' imprisonment, less 117 days for 78 days pretrial custody, and two years' probation - The court also imposed a 10 year firearms prohibition and a DNA order.
