Summary:

The accused was convicted of robbery contrary to s. 302 of the Criminal Code and was sentenced to four years' imprisonment. The accused appealed against sentence.

The Alberta Court of Appeal allowed the appeal and reduced the sentence to three years' imprisonment.

Sentence - Robbery - Criminal Code, R.S.C. 1970, c. C-34, s. 302 - The accused met the complainant in a bar and later went to his room - When a friend of the accused arrived the accused rendered the complainant unconscious by hitting him over the head with a bottle and a travel iron - The accused then stole money - No degree of sophistication - Accused had already given complainant her name and address - No guilty plea - The Alberta Court of Appeal reduced the accused's sentence from four to three years' imprisonment.
