Saskatchewan Provincial Court

Lee, J.

February 13, 1981.

Summary:

The accused was charged with selling liquor to a minor contrary to s. 145(1) of the Liquor Licensing Act.

The Saskatchewan Provincial Court dismissed the charge on the ground that the Crown failed to prove that the person served was under 19 years of age.

Liquor Control - Topic 3561

Offences - Sale to a minor - Proof of age - The Saskatchewan Provincial Court held that the Crown had the onus of proving that the purchaser was a minor - See paragraphs 14 to 29.

Criminal Law - Topic 253

Abuse of process - What constitutes oppressive conduct by the Crown constituting an abuse of process - The Crown delayed 10 days before notifying the accused of a charge of selling liquor to a minor - The accused made 30 to 40 "off sales" per day and had no recollection of the transaction in question - The Saskatchewan Provincial Court held that such a delay did not constitute an abuse of process - See paragraph 9.
