Summary:
The accused was convicted of impaired driving causing bodily harm after he drove through a red light with a blood-alcohol level of .12, striking another vehicle and seriously injuring its driver. The trial judge sentenced the accused to a conditional sentence of two years less a day plus a five year driving prohibition. Both the accused and Crown sought leave to appeal.
The Manitoba Court of Appeal, Lyon, J.A., dissenting in part, allowed the accused's sentence appeal. The court reduced the conditional sentence to 15 months and the driving prohibition to three years.

Sentence - Impaired driving causing bodily harm - The accused was convicted of impaired driving causing bodily harm after he drove through a red light with a blood-alcohol level of .12, striking another vehicle and seriously injuring its driver - The trial judge imposed a conditional sentence of two years less a day plus a five year driving prohibition - Previous conviction for impaired driving at age 17 - Victim seriously injured - Running of red light not preceded by erratic, risky or dangerous driving - Apart from his drinking and driving, the accused was a responsible young adult with a family - Case law showed that the "usual range" for such offences was 3-18 months, with a trend towards more severe sentences - The Manitoba Court of Appeal stated that this trend did not justify an increase of 1/3 over the top of the previous range - The court reduced the conditional sentence to 15 months and the driving prohibition to three years.
