Summary:

Mitchiel McArthur was convicted of attempted murders and other serious offences arising out of a bank robbery. The Crown sought an order pursuant to s. 752.1 of the Criminal Code that McArthur be remanded for assessment. The Crown intended to apply to the court to find that McArthur was a "dangerous offender" and to thereby sentence him to an indeterminate period of detention pursuant to Part XXIV of the Criminal Code. McArthur challenged the constitutionality of s. 752.1 under ss. 7, 8 and 11 of the Charter.

The Ontario Court (General Division) held that s. 752.1 did not violate the Charter.
