The accused pleaded guilty to manslaughter and was sentenced to nine years' imprisonment. The accused appealed his sentence.

Sentence - Manslaughter - The 51 year old accused pleaded guilty to manslaughter - During an argument, he struck one blow to his live-in girlfriend, who fell and hit her head, causing her death - Under a no-contact order (imposed the very morning of the offence), and on probation at the time - Lengthy history of substance abuse and of assaultive behaviour towards the women with whom he lived - Prior convictions involving four different women, including assaults and threats - A risk of "violent reoffending" - 1.5 years pre-sentence custody - The British Columbia Court of Appeal affirmed a sentence of nine years' imprisonment.
