Summary:

The accused was convicted of robbing a bank contrary to s. 344 of the Criminal Code.

The New Brunswick Provincial Court sentenced the accused to four years' impri­sonment.

Sentence - Robbery - In 1995, Mitchell, age 48, robbed a bank of $5,000 by in­forming a teller that he had a gun - Ap­prehended three days later - He had shaved off his mustache - None of the money was recovered - Mitchell claimed that he was under the influence of alcohol and non-prescribed drugs - Informed police that he was going to give himself up - Between 1964 and 1988, Mitchell was convicted of six theft and theft related cases, assault, threatening communications and two pro­bation violations - The most serious were two robbery offences in 1979 for which he received a total of two years less a day - Mitchell had left school in grade eight at age 16 - Divorced - Long history of substance addiction - The New Brunswick Provincial Court sentenced Mitchell to a four year term of incarcera­tion.
