Fraudulent transactions - Fraud - What constitutes - Criminal Code of Canada, R.S.C. 1970, c. C-34, s. 338(1) - The accused woman in applying for social assistance under the Manitoba Social Allowances Act, R.S.M. 1970, c. F-160, failed to disclose that she was employed and received more social assistance than she was entitled to - The accused was charged with fraud under s. 338(1) - The accused submitted that mere silence and non disclosure, as opposed to an act of misrepresentation, was not fraud - The Manitoba County Court convicted the accused and held that the dishonesty necessary for fraud may include secrecy and concealment of material facts.
