Summary:

The accused were charged with unlawful possession of tobacco contrary to s. 240(1) of the Excise Act after an R.C.M.P. officer stopped their van and noticed the tobacco in the back. The accused argued that their right not to be arbitrarily detained under s. 9 of the Charter was infringed and that the evi­dence obtained should be excluded under s. 24(2) of the Charter.

The New Brunswick Provincial Court held that there had been a violation of the ac­cuseds' Charter rights and found them not guilty.
