Indian and Eskimo rights - Right to fish - The accused Indians were apprehended fishing by illegal means at a dam fishway, where fishing was prohibited under the Fisheries Act, R.S.C. 1970, c. F-14, s. 25(1) - The accused relied on an alleged aboriginal or treaty right to fish - The New Brunswick Provincial Court convicted the accused of a violation of s. 25(1) and held that the accused were subject to the Fisheries Act and its regulations, which were paramount over any Indian treaty rights.
