Summary:
The accused was convicted of numerous counts of sexual assault. He was declared to be a dangerous offender within the meaning of Part XXIV of the Criminal Code. He was ordered to serve a sentence of detention for an indeterminate period in lieu of any other sentence that might be imposed. The accused appealed.
The British Columbia Court of Appeal dismissed the appeal.

Dangerous offenders - Detention - Evidence - Experts - On a dangerous offender application, the Crown called eight psychiatrists - After five experts testified, defence counsel objected under s. 7 of the Canada Evidence Act - The issue was not dealt with until after seven experts testified, perhaps due to a "collective memory lapse" - After number seven testified, the trial judge ruled that he would have granted leave for number six and seven to testify and admitted their evidence with a nunc pro tunc ruling - The eighth expert's testimony was admitted because he was the psychiatrist designated by the Crown and the defence was aware of the nature of his testimony - The British Columbia Court of Appeal refused to disturb the trial judge's ruling respecting the experts' testimony - See paragraphs 12 to 25.
