Summary:

This case arose out of two charges of kidnapping, two charges of indecent assault and one charge of gross indecency against the accused. The accused truck driver picked up two female hitchhikers, tied them up in the sleeper of the truck and later sexually assaulted them and forced one of them to commit fellatio. The accused was charged and convicted of two charges of indecent assault contrary to s. 159 of the Criminal Code of Canada, R.S.C. 1970, c. C-34, two charges of kidnapping contrary to s. 247(1) of the Criminal Code and one charge of gross indecency contrary to s. 157 of the Criminal Code. The accused was sentenced to six years imprisonment on each charge of kidnapping and four years imprisonment on each of the other charges to run concurrently. The accused appealed from conviction and sentence.

The Alberta Court of Appeal dismissed the appeal and affirmed the convictions and sentences.

The Court of Appeal held that the moving of the two hitchhikers from place to place in the truck was an essential ingredient of the offence of kidnapping.
