Motor vehicles - Impaired driving - Breathalyzer - Refusal - The 77 year old accused was involved in a single vehicle accident - He was given a breathalyzer demand - He refused - At the police station he asked to consult his lawyer - After consulting with his lawyer, he offered to take the test - The Nova Scotia Provincial Court held that the accused's subsequent offer was made within a reasonable time and should have been accepted - In appropriate circumstances an initial refusal may be taken as a request to consult counsel.
