Summary:

The accused applied for prohibition and certiorari to end two summary conviction prosecutions, which were commenced by informations dated April 13, 1981. The trial date, which was set for late September 1981, was advanced several weeks at the request of the accused and with the Crown's consent. The trial date was then postponed until January 1982 at the request of the Crown and with the accused's consent. In January the Crown requested a further adjournment. The accused refused to consent to the adjournment. The Territorial Court dismissed the Crown's application for an adjournment. The Crown entered a stay of proceedings under s. 732.1 of the Criminal Code of Canada, R.S.C. 1970, c. C-34. The Crown recommenced the proceedings in April 1982. The accused applied for prohibition and certiorari, submitting that the prosecutions were an abuse of the court's process and that they infringed paragraph 11(b) of the Constitution Act (1982) which provided that "any person charged with an offence has the right to be tried within a reasonable time". The Northwest Territories Supreme Court dismissed the application.
