Summary:

The accused was charged with drug offences. He applied to exclude evidence obtained from a search of his residence. He asserted that the search warrant should not have been issued and consequently, his s. 8 Charter rights had been violated.

The Newfoundland and Labrador Provincial Court allowed the application. There was a violation of s. 8 of the Charter.
