Summary:

The accused pleaded guilty to operating an all-terrain vehicle within Gros Morne National Park contrary to s. 41(2) of the National Parks Highway Traffic Regulations, thereby committing an offence contrary to s. 24(2) of the Canada National Parks Act, and failing to stop for a peace officer contrary to s. 15(2) of the Motorized Snow Vehicles and All-Terrain Vehicles Regulations, thereby committing an offence contrary to s. 22(2) of the Motorized Snow Vehicles and All-Terrain Vehicles Act.

The Newfoundland and Labrador Provincial Court sentenced the accused to fines totalling $800 and an order prohibiting him from operating an "over-snow" vehicle or all-terrain vehicles with Gros Morne National Park for a period of one year.

Sentencing - General - Consecutive sentence - Reduced total term - Totality principle - The accused pleaded guilty to operating an all-terrain vehicle within Gros Morne National Park contrary to s. 41(2) of the National Parks Highway Traffic Regulations, thereby committing an offence contrary to s. 24(2) of the Canada National Parks Act, and failing to stop for a peace officer contrary to s. 15(2) of the Motorized Snow Vehicles and All-Terrain Vehicles Regulations, thereby committing an offence contrary to s. 22(2) of the Motorized Snow Vehicles and All-Terrain Vehicles Act - The Newfoundland and Labrador Provincial Court stated that "[the accused's] fleeing must be considered in imposing sentence for the section 15(2) Motorized Snow Vehicles and All-Terrain Vehicles Regulations offence because it is the manner in which he committed the actus reus of that offence. However, it cannot be ignored (as if it did not occur) in imposing sentence for the section 24(2) Canada National Parks Act offence because it constitutes an aggravating factor. For instance, if [the accused] had not been charged with the Motorized Snow Vehicles and All-Terrain Vehicles Act offence, the fleeing from the park warden would still be a factor to be considered in imposing sentence relation to the Canada National Parks Act offence. ... Considering the same factor in relation to more than one offence will not constitute 'doubling-up' ... if after imposing sentence for each offence the sentencing judge takes a final look to ensure that the total sentence imposed (including considering that one factor has been considered twice) is proportionate." - See paragraphs 48 and 49.
