Summary:
The accused pled guilty to offences under the Securities Act. He applied for a stay of the sentence pending an appeal to the Supreme Court of Canada respecting a ruling by the Alberta Court of Appeal that, despite the maximum penalties available under s. 194 of the Securities Act, a jury was not required to be available to the accused.
The Alberta Court of Appeal, per Watson, J.A., granted the stay.
