Summary:

The accused texted Guray's cellphone to arrange a sale of a kilogram of cocaine to Guray. Police arrested Guray during the text conversation, seized the cellphone and continued the text conversation with the accused. The police arranged to meet the accused, where they arrested him. A subsequent warrantless search of the accused's vehicle and search of his residence, after obtaining a search warrant, led to three drug-related charges. At trial, the accused conceded that he lacked status to seek to exclude evidence on the basis of the breach of Guray's Charter rights. However, the accused argued that he had an expectation of privacy in the text messages sent to Guray and his own s. 8 Charter right to be secure from an unreasonable search and seizure was infringed when the police read his text messages on Guray's cellphone.

The British Columbia Supreme Court, in a judgment reported [2013] B.C.T.C. Uned. 1909, held that the accused's s. 8 Charter rights were infringed when the police read his text messages on Guray's cellphone. Guray's arrest was unlawful (lack of reasonable and probable grounds). Absent the text messages, the police lacked reasonable and probable grounds to arrest the accused and search his vehicle. In a subsequent judgment ([2013] B.C.T.C. Uned. 2486), the court held that the warrant to search the accused's residence was unlawful. All of the evidence obtained was excluded under s. 24(2) of the Charter and the accused was acquitted on all charges. The Crown appealed, arguing that the accused's s. 8 Charter rights were not infringed where he could have no reasonable expectation of privacy in text messages once they were received by the recipient, as the accused had no control over whether they remained private or not.

The British Columbia Court of Appeal dismissed the appeal. The accused had a reasonable expectation of privacy in the text messages sent to Guray's cellphone. The accused's subjective belief that his text messages were private was objectively reasonable. The police, by reading those text messages, violated the accused's s. 8 Charter rights. The trial judge did not err in excluding the evidence under s. 24(2) and acquitting the accused. Goepel, J.A., dissenting, would have dismissed the appeal and remitted the matter for a new trial on the ground that any reasonable expectation of privacy in the text messages ended when they were received by the recipient.
