British Columbia Court of Appeal

Garson, MacKenzie and Harris, JJ.A.

June 21, 2012.

Summary:

The accused was convicted of the second degree murder of his estranged wife. He was sentenced to mandatory life imprisonment without eligibility for parole for 19 years. He appealed his conviction, raising evidentiary concerns regarding the handling of the evidence of the 11 year old daughter of the accused and the deceased and a Crown witness. The accused also applied to introduce fresh evidence in support of a new trial on the ground that the Crown failed to disclose evidence relating to the integrity and continuity of exhibits involving DNA linking him to the murder.

The British Columbia Court of Appeal, in a decision reported (2008), 252 B.C.A.C. 150; 422 W.A.C. 150, dismissed the application to receive fresh evidence and dismissed the appeal. The order dismissing the appeal was entered. An application for leave to appeal to the Supreme Court of Canada was not pursued. The accused sought to reopen the appeal to have the court consider further evidence which the accused asserted would put into serious question the jury's verdict.

The British Columbia Court of Appeal, in a decision reported (2010), 293 B.C.A.C. 248; 496 W.A.C. 248, dismissed the application to re-open. The court held that it did not have jurisdiction to re-open an appeal from conviction where the conviction appeal had been dismissed on its merits and the order entered. The accused applied for leave to appeal his conviction.

The Supreme Court of Canada, in a decision reported (2012), 432 N.R. 393; 322 B.C.A.C. 320; 549 W.A.C. 320, dismissed the accused's application for leave to appeal his conviction. The accused then appealed the 19 year period of parole ineligibility on the basis that the sentence judge erred by relying on the accused's lack of remorse and poor prospects for rehabilitation.

The British Columbia Court of Appeal dismissed the appeal.

Punishments (sentence) - Imprisonment and parole - Parole - Period of ineligibility - The accused was convicted of the second degree murder of his estranged wife - He was sentenced to mandatory life imprisonment without parole eligibility for 19 years - He appealed, arguing that the sentencing judge erred by relying on the accused's lack of remorse and poor prospects for rehabilitation - He submitted that such error produced an unfit sentence that was outside the appropriate range for the second degree murder of a spouse - He sought to have the period of parole ineligibility reduced to 12-15 years - The British Columbia Court of Appeal dismissed the appeal - There was no basis upon which to interfere with the sentence - The judge's ruling was entitled to deference.
