Summary:

The accused was charged with impaired driving and driving while over the legal limit. He alleged that his ss. 8 and 10(b) Charter rights had been violated and applied for exclusion of the evidence.

The Saskatchewan Provincial Court dismissed the application.

Motor vehicles - Impaired driving - Breathalyzer or blood sample - Demand for - A police officer (Lingelbach) was directing traffic around an accident scene - Around 5:00 p.m., Reid stopped his vehicle and asked Lingelbach for an alternate route to proceed on - Lingelbach noticed that Reid had bloodshot eyes, slurred speech, and that there was an open can of beer in the centre console - Lingelbach directed Reid to pull over - He arrested Reid at 5:04 p.m. and put him in the back of the police vehicle - He then called for back-up and returned to directing traffic - Another officer arrived at 6:23 p.m. to take over directing traffic - Lingelbach returned to the police car and made a breath demand - Reid provided breath samples at 6:47 p.m. and 7:11 p.m., both of which were in excess of the legal limit - He was charged with impaired driving and driving while over the legal limit - Reid argued that the breath demand had not been made "as soon as practicable" - He claimed that his s. 8 Charter rights had been violated and applied for exclusion of the breath test results - The Saskatchewan Provincial Court dismissed the application - There was no s. 8 violation - The demand was made as soon as practicable - Lingelbach could not have safely left his traffic control duties until he was replaced by another officer - He had no control over how long it took for the other officer to arrive - Lingelbach acted reasonably, diligently and in good faith - See paragraphs 22 to 38.

Right to counsel - General - Denial of or interference with - What constitutes - A police officer (Lingelbach) was directing traffic around an accident scene - Around 5:00 p.m., Reid stopped his vehicle and asked Lingelbach for an alternate route to proceed on - Lingelbach noticed that Reid had bloodshot eyes, slurred speech, and that there was an open can of beer in the centre console - Lingelbach directed Reid to pull over - He arrested Reid at 5:04 p.m. and put him in the back of the police vehicle - He then called for back-up and returned to directing traffic - Another officer arrived at 6:23 p.m. to take over directing traffic - Lingelbach returned to the police car and advised Reid of his right to counsel - Reid declined - He was subsequently charged with impaired driving and driving while over the legal limit - He argued that his s. 10(b) Charter rights had been violated and applied for exclusion of the breath test results - The Saskatchewan Provincial Court dismissed the application - The delay in advising Reid of his right to counsel was a s. 10(b) violation, but it was a very minor and technical violation - Even if Reid had been advised of his right to counsel immediately, it would have been impractical to implement it at the scene because it would have required Lingelbach to jeopardize the safety of other people by abandoning his traffic control duties for an uncertain amount of time - There was no connection between the breach and the evidence obtained - Reid had been advised of his right to counsel and waived it before he was questioned or otherwise required to participate in evidence gathering procedures - No remedy was required - See paragraphs 12 to 21.
